Terms of Service

In short: your association owns its data and can export it anytime, payments run through Stripe, use the Service lawfully and kindly, and if you ever leave we make departure easy. The full terms follow.
1. Agreement to these terms
By creating an account or using HostedHOA (the “Service”, operated at hostedhoa.com), you agree to these Terms of Service. If you use the Service on behalf of a homeowner association or similar community (a “Community”), you represent that you are authorized to bind that Community to these terms.
2. The service
HostedHOA provides community websites, resident portals, communication tools, and management features — dues, documents, events, requests, accounting, voting, and related capabilities — for Communities. We may add, improve, or retire individual features over time; we will not materially reduce the core Service your Community pays for during a paid term without notice.
3. Community authority & administrators
The person who sets up a Community represents that the Community’s board has authorized use of the Service. Community administrators control who can access the Community’s portal, what roles members hold, and what content is public. As between HostedHOA and the Community, the Community is responsible for the accuracy of its content and for its decisions — including membership approvals, dues assessments, and governance actions recorded in the Service.
4. Accounts
You are responsible for your account credentials and for activity under your account. Provide accurate information, keep your password safe, and consider enabling two-factor authentication — we recommend it strongly for board members and administrators. We may suspend accounts that violate these terms or put the Service or other users at risk.
5. Acceptable use
Use the Service only for lawful community purposes. Do not upload content that is unlawful, infringing, harassing, or malicious; do not attempt to probe, disrupt, or overload the Service; do not attempt to access another Community’s private data or another user’s account. Security research is welcome through our responsible disclosure process, not against live communities.
6. Your content & your data
Your Community owns the content and data it puts into the Service. You grant us only the limited license needed to host, display, and transmit that content in order to operate the Service. You are responsible for having the rights to what you post.
No lock-in: Community administrators can export the Community’s complete data from the Service at any time, in open formats.
7. Payments
When a Community enables online payments, dues and donations are processed by Stripe under Stripe’s own terms; card details go to Stripe directly and never touch our servers. Payments collected through the Service are the Community’s funds — HostedHOA is not a party to the underlying obligation between a Community and its members, and refunds are directed by the Community.
Subscription fees for the Service itself, where applicable, are billed as agreed at signup and are non-refundable except where required by law.
8. Availability
We work hard to keep the Service available and back its data with nightly backups, but the Service is provided without a contractual uptime guarantee. We may perform maintenance, and we will use reasonable efforts to schedule disruptive maintenance outside common usage hours.
9. Termination & moving out
You may stop using the Service at any time, and a Community may terminate by notice to us. We may suspend or terminate access for material breach of these terms. After a Community’s termination takes effect, its administrators retain access to the data export for 30 days, after which the Community’s data is deleted from the Service (backups age out within a further 14 days).
10. Disclaimers & limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, HostedHOA will not be liable for indirect, incidental, special, or consequential damages, and our total liability arising out of the Service is capped at the amounts the Community paid us for the Service in the twelve months before the claim.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
12. Changes to these terms
We may update these terms from time to time. For material changes we will post the updated terms here with a new “last updated” date and notify Community administrators. Continued use of the Service after changes take effect means you accept the new terms.
